Terms of Service

1. Acceptance of Terms

By accessing or using Reservation Wrangler ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. By creating an account, you represent that you are at least 18 years of age and have the legal capacity to enter into this agreement.

2. Description of Service

Reservation Wrangler provides automated restaurant reservation monitoring and booking services. The Service monitors third-party reservation platforms (including but not limited to Resy, OpenTable, and SevenRooms via DoorDash) for availability and attempts to book reservations on your behalf based on your specified preferences.

We do not guarantee that any reservation will be successfully secured. Availability is determined by third-party platforms and restaurants, and is beyond our control.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Notify us immediately of any unauthorized use of your account
  • Not share your account with others or allow others to access your account
4. Third-Party Platform Disclaimer

THIS IS AN IMPORTANT SECTION. PLEASE READ CAREFULLY.

Reservation Wrangler is NOT affiliated with, endorsed by, sponsored by, or associated with Resy, OpenTable, SevenRooms, DoorDash, or any other third-party restaurant reservation platform. All trademarks and brand names are the property of their respective owners.

By using the Service, you expressly acknowledge and agree that:

  • Account Risk: The use of automated tools to interact with third-party reservation platforms may violate those platforms' terms of service. Your accounts on Resy, OpenTable, SevenRooms, DoorDash, or any other connected platform may be suspended, restricted, banned, or permanently terminated as a result of using our Service.
  • No Liability for Account Actions: Reservation Wrangler is NOT responsible for any consequences arising from the use of our Service on third-party platforms, including but not limited to account suspension, bans, restrictions, loss of reservations, loss of loyalty points or rewards, or any other adverse actions taken by third-party platforms against your account.
  • Assumption of Risk: You voluntarily assume ALL risk associated with connecting your third-party platform accounts to our Service and using our automated monitoring and booking features.
  • Your Credentials: You are solely responsible for the credentials you provide to us for third-party platforms. You represent that you have the right to use those credentials and that providing them to us does not violate any agreement you have with the third-party platform.
5. Data and Security Disclaimer

We implement industry-standard security measures to protect your data, including encryption of stored credentials and secure data transmission. However:

  • We store your information, including third-party platform credentials, using commercially reasonable security practices. While we use encryption and other protective measures, no system is 100% secure.
  • We are NOT liable for any unauthorized access to, theft of, or loss of your data, including but not limited to your account information, personal data, or third-party platform credentials, regardless of the cause.
  • We make NO guarantees or warranties regarding the absolute security of your data stored on our platform.
  • In the event of a data breach, we will make commercially reasonable efforts to notify affected users in accordance with applicable law.
6. Subscription and Payment

Certain features of the Service require a paid subscription. By subscribing, you agree to pay the applicable fees. Subscriptions automatically renew unless cancelled before the renewal date. Refunds are handled in accordance with our refund policy and at our sole discretion.

7. Prohibited Uses

You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Resell, sublicense, or commercially exploit reservations obtained through the Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Attempt to gain unauthorized access to the Service or its related systems
  • Use the Service for any purpose that is fraudulent, deceptive, or harmful
  • Create multiple accounts to circumvent usage limits or bans
8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RESERVATION WRANGLER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE EXCEED THE AMOUNT PAID BY YOU TO US DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

9. Indemnification

You agree to indemnify, defend, and hold harmless Reservation Wrangler and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including any third-party platform's terms of service
  • Any claim that your use of the Service caused damage to a third party
  • Your provision of third-party platform credentials to us
10. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice, at our sole discretion. Upon termination, your right to use the Service will immediately cease. We will delete your stored credentials upon account termination.

You may terminate your account at any time through your account settings or by contacting us at support@reservationwrangler.nyc.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after any modifications constitutes your acceptance of the revised Terms.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in New York County, New York, and you consent to the personal jurisdiction of such courts.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Reservation Wrangler regarding the use of the Service and supersede all prior agreements and understandings.
